Terms and Conditions

These Terms cover collection tracking, community, trading and the StickMarket marketplace, including listings, checkout, shipping, reviews and seller transfers.

Buying, selling, trading and collection tools share one account.

These Terms explain how listings, checkout, payments, shipping, reviews, seller transfers, community activity and user trades work across StickMarket.

Consumer protections may differ between purchases from a professional seller and purchases from a private individual. StickMarket displays the seller status with marketplace offers where available.

1. Scope and acceptance

These Terms govern use of StickMarket, including collection tracking, community, trading and marketplace services.

  • By creating an account, using the platform, accepting a trade, publishing a listing, placing an order or otherwise using StickMarket, you agree to these Terms and the Privacy Policy.
  • Additional terms shown during seller onboarding, checkout, shipping or a specific promotion form part of these Terms where applicable.
  • You must be legally capable of entering into binding agreements. Users under the applicable age of legal capacity may use StickMarket only with permission and supervision from a parent or legal guardian.

2. StickMarket's role

StickMarket provides catalogue, communication, trading, listing, payment-support and order-management tools.

  • For marketplace sales, the purchase contract is normally between the buyer and the seller identified in the offer. StickMarket is the intermediary platform and is not the owner of the listed item unless an offer expressly states otherwise.
  • StickMarket does not manufacture, authenticate, grade, inspect, possess or guarantee every item offered by users.
  • StickMarket may facilitate payment collection, reservations, shipping selection, order status, reviews, dispute handling and seller transfers without becoming the seller of the goods.

3. Accounts and identity

Accurate account and seller information is required for trust, payments and legal compliance.

  • You must provide accurate information, keep it current and protect your credentials. You are responsible for activity performed through your account.
  • One person or business may not create accounts to evade restrictions, manipulate reviews, abuse promotions or conceal identity.
  • Sellers may be required to complete identity, address, bank-account, tax or business verification through Stripe or directly with StickMarket before listing or receiving transfers.
  • StickMarket may request additional evidence where fraud, impersonation, counterfeiting, account takeover or regulatory risk is suspected.

4. Private and professional sellers

Consumer rights can differ depending on whether the seller acts privately or in the course of a business.

  • Sellers must correctly identify themselves as private or professional and must update that status if their activity changes.
  • Professional sellers are responsible for complying with all applicable consumer, distance-selling, pricing, invoicing, tax, product-safety, withdrawal, conformity and warranty obligations.
  • Purchases from private sellers may not carry the statutory withdrawal rights and other protections that apply when buying from a professional seller.
  • StickMarket may display seller status, identity information required by law and notices explaining which consumer protections apply.

5. Catalogue and item information

The StickMarket catalogue helps identify collectibles but does not replace the seller's description.

  • Catalogue names, numbers, images, variants, publishers, years and other metadata may contain mistakes or omissions and may be corrected at any time.
  • The seller is responsible for ensuring that the listing refers to the correct catalogue item and accurately describes condition, variant, language, quantity, defects and any other material characteristic.
  • Buyers must review the complete offer, condition and seller information before ordering.
  • Historic prices, averages, demand indicators and similar statistics are informational only and are not valuations, guarantees or investment advice.

6. Listings and seller obligations

A listing is an offer to sell the stated quantity under the conditions shown on the item page.

  • You may list only items you own, are entitled to sell and can dispatch within the stated timeframe.
  • Listing information must be accurate, lawful and not misleading. Sellers must keep quantity and availability current and remove listings that can no longer be fulfilled.
  • Sellers must package items appropriately, use the selected shipping method and provide valid tracking information when tracking is required.
  • StickMarket may pause, remove or correct listings and may restrict selling where inventory, payment readiness, account status, legal compliance or platform safety requirements are not met.

7. Prohibited items and conduct

Illegal, unsafe, fraudulent and rights-infringing activity is not permitted.

  • Do not list counterfeit, stolen, illegally reproduced, unsafe, recalled, prohibited or unlawfully obtained goods.
  • Do not manipulate prices, sales history, availability, reviews, search results, accounts or platform metrics.
  • Do not direct users off-platform to avoid fees or protections after meeting through the marketplace, and do not request payment through unsafe or undisclosed methods.
  • Do not harass, threaten, discriminate against, impersonate, scam or misuse another user's personal data.
  • Users may report suspected illegal items, fraud, intellectual-property infringement or other prohibited content through StickMarket's reporting and contact tools.

8. Orders, reservations and contract formation

Stock may be reserved while a buyer completes payment.

  • Adding an item to the cart does not reserve it. A temporary reservation is created only when the checkout process creates an order.
  • Reservations normally expire after approximately 30 minutes if payment is not completed. StickMarket may release reserved stock and cancel the pending order after expiry.
  • An order is not treated as paid merely because the buyer returns from Stripe. Payment confirmation is based on the payment provider's verified status and webhook notification.
  • StickMarket may cancel or refuse an order before fulfilment where stock is unavailable, pricing is clearly erroneous, payment fails, fraud is suspected or the transaction would violate these Terms or applicable law.

9. Prices, fees, taxes and currency

Marketplace prices are displayed and processed in euros unless stated otherwise.

  • The buyer pays the item subtotal, applicable shipping and any other amount clearly shown before confirming checkout.
  • StickMarket charges the seller a platform fee equal to 5% of the item subtotal. Shipping is excluded from the platform-fee calculation unless stated otherwise.
  • Payment-provider charges, refunds, disputes, currency conversion and other costs may affect the amount ultimately received by a seller where permitted by law and these Terms.
  • Sellers are solely responsible for determining, declaring and paying taxes, duties, VAT, income tax or other charges arising from their activity. StickMarket may collect, retain or report information where legally required.

10. Stripe payments and seller accounts

Stripe processes marketplace payments and operates connected seller accounts.

  • Buyers and sellers may also be subject to Stripe's terms, privacy notices and verification requirements.
  • Sellers must complete Stripe Connect onboarding and keep their payout account eligible. Stripe or StickMarket may restrict payments or transfers while information is missing, under review or legally restricted.
  • StickMarket may create payment sessions, hold funds at platform level and transfer seller proceeds after the applicable release conditions are met.
  • Payment credentials are handled by Stripe. StickMarket does not store full card details.

11. Shipping and delivery

Shipping obligations depend on the method selected during checkout.

  • The buyer must provide a complete and accurate delivery address. Costs caused by incorrect or incomplete details may be allocated to the responsible party where legally permitted.
  • The seller must dispatch within the stated timeframe, package the goods appropriately and use tracking when the chosen method requires it.
  • Estimated delivery times are not guaranteed and may be affected by carriers, customs, weather, strikes, incorrect addresses and other events outside StickMarket's control.
  • For tracked orders, the buyer should confirm delivery after receiving and checking the goods. For untracked orders, the buyer accepts the additional evidential risk inherent in a service without end-to-end tracking.

12. Seller proceeds and transfer timing

Seller proceeds are released only after the order reaches the applicable transfer condition.

  • For tracked shipping, seller proceeds become eligible when the buyer confirms delivery, or automatically seven days after the seller marks the order shipped if no earlier confirmation is received.
  • For untracked shipping, seller proceeds become eligible 24 hours after the seller marks the order shipped.
  • Eligibility does not guarantee immediate bank receipt. Stripe processing, verification, reserves, weekends, banking delays, disputes, refunds or legal restrictions may delay or prevent a transfer.
  • StickMarket may withhold, delay, reverse or offset seller proceeds where reasonably necessary to address refunds, disputes, chargebacks, fraud, negative balances, legal obligations or breaches of these Terms.

13. Cancellations, withdrawals, refunds and disputes

The available remedy depends on seller status, payment status, shipping status and applicable law.

  • Pending-payment orders may be cancelled or expire before payment. After payment, cancellation is not automatic and may depend on fulfilment status and applicable consumer law.
  • Professional sellers must honour statutory consumer rights, including withdrawal and conformity rights where they apply. Private-sale purchases may not include a statutory 14-day withdrawal right.
  • Buyers should report missing, materially misdescribed, damaged or counterfeit items promptly and provide relevant evidence. Sellers must cooperate reasonably with the investigation.
  • Refunds, partial refunds, Stripe disputes and chargebacks may result in transfer withholding or reversal. Abuse of dispute mechanisms may lead to account restrictions.
  • Nothing in these Terms limits mandatory rights that cannot legally be excluded.

14. Reviews and trust signals

Trading reviews and marketplace reviews are separate records based on different transactions.

  • Marketplace reviews must relate to a genuine completed marketplace order and should fairly describe shipment time, package condition and communication.
  • Trading reviews relate only to collector trades and are not counted as marketplace sales reviews unless clearly stated.
  • StickMarket may remove, hide or restrict reviews that are fabricated, abusive, retaliatory, irrelevant, manipulated or otherwise unlawful.
  • Ratings and badges are informational trust signals and do not guarantee later conduct or item authenticity.

15. Community and trading

User trading is distinct from paid marketplace sales.

  • Users are responsible for the accuracy, condition, packaging, shipping and fulfilment of items included in a trade.
  • A trade must be managed through the trade workflow and confirmed only after the items have been received and checked.
  • Marketplace payment protections, seller transfers and marketplace reviews do not automatically apply to trades or off-platform arrangements.
  • Community messages and content must comply with the conduct rules in these Terms and may be moderated for safety and legal compliance.

16. Moderation, suspension and enforcement

StickMarket may act to protect users, comply with law and preserve platform integrity.

  • StickMarket may investigate reports, request evidence, limit features, remove content, pause listings, hold transfers, suspend accounts or terminate access.
  • Where appropriate, users will receive a reason for a moderation decision and information about available review or appeal channels.
  • Serious or repeated breaches, fraud, illegal goods, threats, payment abuse, chargeback abuse or evasion of enforcement may result in immediate restriction.
  • StickMarket may preserve and disclose information to payment providers, carriers, professional advisers, regulators or law-enforcement authorities where legally required or reasonably necessary.

17. Intellectual property

Third-party names and images are used for catalogue identification and remain owned by their respective rights holders.

  • StickMarket is not affiliated with Panini, Topps or another publisher unless expressly stated.
  • Users may upload or submit only content they are entitled to use and grant StickMarket the limited rights needed to host, display, moderate and operate that content.
  • Rights holders may report allegedly infringing material through the contact page with enough information to identify the work, content and legal basis of the request.

18. Availability and liability

StickMarket is provided on an as-available basis and depends on third-party infrastructure.

  • Features may be changed, interrupted, restricted or discontinued for maintenance, security, legal, operational or development reasons.
  • To the maximum extent permitted by law, StickMarket is not liable for indirect or consequential losses, lost profits, loss of opportunity, carrier failures, user conduct or inaccurate catalogue information.
  • Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable.
  • Users remain responsible for maintaining their own records, evidence, tax documentation and backups of important information.

19. Changes, law and contact

Material changes may require marketplace sellers to accept a new terms version.

  • StickMarket may amend these Terms to reflect new features, legal requirements, security needs or business changes. The current version and effective date are shown on this page.
  • Where a change materially affects marketplace sellers, StickMarket may require fresh acceptance before new listings can be published.
  • These Terms are governed by Portuguese law, without removing mandatory protections available under the law of the user's country of residence.
  • Questions, legal notices and complaints may be submitted through the Contact page. Consumers may also use applicable official complaint and alternative-dispute-resolution channels.

Goods invoices and platform fee documents

Professional sellers are responsible for issuing the legally required sales document for the goods they sell. StickMarket issues or arranges documents only for its marketplace service fee and provides payout statements that are explicitly not tax invoices. Private sellers may not be able to provide a VAT invoice. Buyers must review the seller classification before purchase.
